Notice Required by Texas Law

Sterilization of this animal is required under Chapter 828, Texas Health and Safety Code. A violation of Chapter 828 is a criminal offense punishable as a Class C misdemeanor.

By signing below, I certify that I am at least 18 years of age and legally competent to enter into this agreement. I have read and understand this agreement and agree to comply with its terms and with Chapter 828 of the Texas Health and Safety Code. I understand that I am responsible for completing sterilization and providing all required documentation by the applicable deadlines. Failure to comply may result in a criminal complaint and lawful reclamation of the animal by DAWG.

Compliance Requirements

Spay / Neuter Requirements

    Confirmation After Sterilization

    The adopter must deliver to DAWG a letter or the attached veterinarian confirmation signed by the veterinarian who performed the sterilization. It must be delivered in person or by mail no later than the seventh day after the animal is sterilized.

    Medical Extension

    If sterilization by the stated completion date may jeopardize the animal's life or health, present DAWG with a written report signed by a licensed veterinarian. DAWG may extend the deadline for 30 days. Additional 30-day extensions may be granted upon presentation of a current veterinarian report.

    Previously Sterilized Animal

    If a veterinarian determines that the animal was previously sterilized, the adopter must return a signed veterinarian confirmation to DAWG. The confirmation should identify the animal and state the veterinarian's professional opinion.

  4. 4

    Death Before Completion Date

    If the animal dies on or before the sterilization completion date, the adopter must deliver a signed statement to DAWG no later than the seventh day after death. The statement must give the date and, if known, the cause of death.

    Loss or Theft Before Completion Date

    If the animal is lost or stolen on or before the sterilization completion date, the adopter must deliver a signed statement to DAWG no later than the seventh day after disappearance. The statement must describe the circumstances and approximate date.

  6. 6

    Transfer Does Not End Responsibility

    Giving away, selling, or otherwise transferring the animal does not relieve the adopter of the obligations in this agreement.

    Failure to Comply and Reclamation

    If DAWG does not receive the required confirmation or statement by the statutory deadline, Chapter 828 requires a complaint to be filed. DAWG may promptly reclaim the animal as permitted by law. A person may not prevent, obstruct, or interfere with a lawful reclamation.

DAWG Early Sterilization Policy

DAWG requires every dog and cat to be spayed or neutered as soon as medically appropriate after reaching three months of age and no later than the four-month birthday, unless DAWG grants a documented veterinary medical extension. For an infant animal, the policy date under Texas Health and Safety Code Section 828.003(b)(3) is 30 days before the estimated four-month birthday; enter the four-month birthday as “Spayed or Neutered no later than.” Adult animals follow Chapter 828's adult-animal deadline. Staff should schedule earlier when a weekend or legal holiday could extend the statutory deadline beyond four months.

Rabies Vaccination

The adopter must comply with all applicable rabies vaccination laws and DAWG adoption requirements. A licensed veterinarian must administer the vaccination. The attached veterinarian confirmation may be used to document the vaccination. If vaccination must be delayed for medical reasons, obtain written guidance from the veterinarian and promptly provide it to DAWG.

Additional Agreement Terms

  • DAWG makes no guarantee or warranty, express or implied, regarding the health, temperament, breed, age, or other characteristics of the animal, except as expressly stated in a separate written adoption agreement.
  • The adopter is responsible for costs and obligations incurred for the animal after release, including veterinary care, licensing, containment, and compliance with applicable law.
  • Any return must be arranged with DAWG in advance. Fees, donations, and expenses are handled under DAWG's current written policies and are not automatically refundable.
  • This sterilization agreement supplements, and does not replace, DAWG's general adoption agreement and policies.
